Brainrotify ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights you have. It applies to our websites, applications, and developer API (the "Service"). By using the Service, you agree to this Policy.

1. Information We Collect

a. Account Information. Your name, email address, password (stored hashed), and, if you sign in with Google, basic profile information from your Google account.

b. Payment Information. Subscriptions and purchases are processed by our payment processor (Stripe). We receive limited billing details (such as plan, status, and a customer identifier) but do not store full payment-card numbers.

c. User Content & Prompts. The audio, video, images, text prompts, scripts, lyrics, URLs, and other inputs you provide or upload to generate content.

d. Generated Content. The AI outputs (videos, audio, images, text) you create, and related metadata such as the settings used.

e. Usage, Device & Log Data. IP address, browser and device type, pages and features used, generation activity, credit usage, API requests, timestamps, and diagnostic logs.

f. Cookies & Analytics. We and our analytics providers use cookies and similar technologies to keep you signed in, remember preferences, and understand product usage.

g. Communications. Messages you send us (e.g., support emails).

2. How We Use Your Information

We use your information to: provide, operate, secure, and maintain the Service; generate the content you request; process transactions and manage subscriptions and credits; authenticate you and prevent fraud, abuse, and security incidents; provide support; analyze and improve the Service; send service-related and, where permitted, marketing communications (which you can opt out of); and comply with legal obligations and enforce our Terms.

3. How We Share Your Information

We do not sell your personal information. We share information only as follows:

a. AI & Processing Providers. To deliver core functionality, we transmit your User Content and prompts to third-party AI providers — including OpenAI, ElevenLabs, Replicate, Fal.ai, and Suno — which process this data to generate your requested outputs and may retain it temporarily for their own safety, abuse-monitoring, and legal purposes under their terms.

b. Infrastructure & Service Providers. Hosting and compute, content delivery and storage (Cloudflare R2), authentication (Google), product analytics, email delivery, and payment processing (Stripe).

c. Legal & Safety. When we believe disclosure is necessary to comply with law or legal process, to enforce our Terms, or to protect the rights, property, or safety of Brainrotify, our users, or others.

d. Business Transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

4. Cookies & Tracking Technologies

We use strictly necessary cookies (for sign-in and security) and analytics cookies (to measure usage). You can control cookies through your browser settings; disabling some cookies may affect functionality.

5. Data Retention

We retain account information for as long as your account is active and as needed to provide the Service and meet legal obligations. Generated Content and associated media may expire and be deleted automatically after a period of time as part of normal operation, or upon account deletion. We may retain certain records (e.g., transaction and security logs) as required by law or for legitimate business purposes.

6. Your Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, port, restrict, or object to the processing of your personal data, and to withdraw consent.

a. EEA/UK (GDPR). Our legal bases include performance of our contract with you, your consent, our legitimate interests (e.g., securing and improving the Service), and legal obligations.

b. California (CCPA/CPRA). You have rights to know, access, delete, and correct your personal information, and to opt out of "sale" or "sharing." We do not sell or share your personal information as those terms are defined. We will not discriminate against you for exercising your rights.

7. Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has provided us information, contact us and we will delete it. Users under the age of majority must have parental or guardian consent as described in our Terms.

8. Data Security

We use commercially reasonable administrative, technical, and organizational measures to protect your information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. International Data Transfers

We and our providers may process and store your information in countries other than your own, including the United States. Where required, we rely on appropriate safeguards for such transfers.

10. Changes to This Policy

We may update this Policy from time to time. We will post the updated version with a new effective date and, for material changes, provide reasonably prominent notice.
